Article 2 – Scope & Acceptance of Terms
2.1 These Terms apply exclusively to all sales of physical goods published on the Seller’s Shopify store. By completing an order checkout, the Customer explicitly accepts these Terms without reservation, superseding any prior verbal or written agreements between the parties.
2.2 The Seller reserves the right to amend these Terms at any time. Amendments shall take effect upon publication on the website and apply only to orders placed after the effective date. The current version is always available on the store’s legal page.
2.3 Any deviation from these Terms requires prior written confirmation from the Seller to be valid.
Article 3 – Product Information & Order Process
3.1 All product descriptions, images, specifications, and dimensions displayed on the store are for illustrative purposes only. Minor visual differences (color, texture, slight size deviation) shall not constitute a product defect, provided the core characteristics of the goods remain unchanged.
3.2 The order process is completed when the Customer submits payment and receives an automated order confirmation email from the Seller. A binding sales contract is formed at the moment of order confirmation.
3.3 The Seller reserves the right to cancel or refuse any order in the following cases: (i) incorrect pricing information due to system error; (ii) out-of-stock inventory; (iii) suspected fraudulent transaction; (iv) violation of export/import regulations for the destination country. In such cases, the Seller shall fully refund any paid amount without additional compensation.
Article 4 – Pricing & Payment Terms
4.1 All prices displayed on the website are denominated in Euro (EUR), inclusive of French VAT (20% standard rate), excluding shipping fees, customs duties, and local import taxes unless explicitly stated otherwise.
4.2 Shipping fees are calculated during checkout based on the customer’s delivery address, package weight, and shipping method, and are clearly displayed before payment confirmation.
4.3 For orders shipped outside the European Union (EU), the Customer shall be deemed the importer of record. All local customs duties, import taxes, clearance fees, and related administrative charges are the sole responsibility of the Customer, and the Seller shall not be liable for these costs.
4.4 Accepted payment methods include all options enabled via Shopify Payments (credit card, debit card, digital wallet, etc.). Payment shall be made in full at the time of order; no installment payment is available unless explicitly marked on the product page.
4.5 All transactions are secured by Shopify’s PCI DSS compliant payment system. The Seller does not store the Customer’s full bank card information on its servers.
Article 5 – Delivery & Risk Transfer
5.1 Delivery zones include metropolitan France, EU member states, and selected international regions as displayed during checkout.
5.2 Estimated processing and delivery times are indicated on the product page and checkout page. Processing time refers to warehouse handling period before dispatch; delivery time refers to transit time after shipment. Delays caused by carrier logistics, customs clearance, force majeure, or customer-provided incorrect address information shall not be the Seller’s liability.
5.3 Risk of loss, damage, or theft of the goods shall transfer to the Customer upon handover of the package to the designated carrier. For delivery to a third-party pickup point, risk transfers when the package arrives at the pickup location.
5.4 The Customer must inspect the package and goods immediately upon receipt. Any visible damage, missing items, or packaging defects must be reported to the Seller within 48 hours of delivery with photographic evidence; no claim shall be accepted after this period.
Article 6 – Right of Withdrawal & Returns (French Consumer Law Compliance)
6.1 For consumer customers (non-professional use), the Customer has a 14-calendar-day withdrawal period starting from the day of receipt of the goods, without justification or penalty, to return the order.
6.2 To exercise the withdrawal right, the Customer shall notify the Seller via the official contact email above before the end of the withdrawal period, stating the order number and return intention.
6.3 Returned goods must be sent back in original, unused, undamaged condition with all original packaging, labels, and accessories intact. The Customer bears the cost of return shipping unless the Seller delivered defective or non-conforming goods.
6.4 Exclusions to the withdrawal right (per French Consumer Code): customized goods, sealed beauty/health products opened by the customer, perishable goods, and digital downloadable products. These items are non-returnable.
6.5 The Seller shall process the full refund (including original shipping fees) within 14 days after receiving and inspecting the returned goods, using the same payment method as the original transaction.
Article 7 – Legal Warranties & After-Sales Service
7.1 All goods benefit from the French legal conformity warranty (2 years) and hidden defect warranty under Articles L217-1 et seq. of the French Consumer Code and Article 1641 of the French Civil Code.
7.2 If the goods are non-conforming or contain hidden defects, the Customer may request repair, replacement, price reduction, or full refund free of charge, within the statutory warranty period.
7.3 After-sales inquiries, warranty claims, and return support shall be handled via the official email and phone listed in Article 1. The Seller will respond to all customer requests within 48 business hours.
Article 8 – Intellectual Property Rights
8.1 All intellectual property rights on the website, including trademarks, logos, text, images, graphics, product designs, and copywriting, are the exclusive property of ICI POP UP / LENG QING. No unauthorized reproduction, distribution, modification, or commercial use is permitted.
8.2 The Customer shall not use the Seller’s intellectual property assets for any purpose outside the scope of personal use of the purchased goods. Any infringement will result in legal liability and compensation for damages.
Article 9 – Personal Data Protection (GDPR Compliance)
9.1 The Seller processes customer personal data (name, delivery address, contact info, payment records) solely for order execution, after-sales service, legal compliance, and anti-fraud purposes, in accordance with EU GDPR and French data protection law.
9.2 Customer data will not be sold to third parties for commercial marketing without explicit opt-in consent. Data is shared only with authorized service providers (Shopify, payment processors, carriers) necessary for order fulfillment.
9.3 The Customer has the right to access, rectify, erase, restrict processing, and data portability of their personal data, by submitting a request via the official contact email.
Article 10 – Consumer Dispute Mediation & Jurisdiction
10.1 In the event of a consumer dispute, the Customer may first contact the Seller for an amicable resolution. If unresolved, the Customer may refer the dispute to a certified French consumer mediation body free of charge.
10.2 These Terms and all contracts formed under them are governed exclusively by French law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10.3 For consumer customers, competent jurisdiction lies with the court of the Customer’s residential address. For professional customers, exclusive jurisdiction lies with the Tribunal de Commerce de Paris, France.
Article 11 – Force Majeure
The Seller shall not be liable for any delay or failure to perform contractual obligations caused by force majeure events (including but not limited to natural disasters, epidemic control measures, governmental regulatory changes, carrier service suspension, supply chain disruption). The Seller will inform the Customer of the event and resume performance as soon as the obstacle is removed.
Article 12 – Severability
If any clause of these Terms is deemed invalid, illegal, or unenforceable by a competent judicial authority, the remaining clauses shall remain in full force and effect. The invalid clause shall be replaced by a legally valid provision closest to the original commercial intent.
